LumiJar Terms of Service

These Terms are an agreement between you and Lumiti, LLC, a California limited liability company ("Lumiti," "we," "us"). LumiJar is a product of Lumiti, LLC, available at https://lumijar.com. By creating an account or using LumiJar, you agree to these Terms and to our Privacy Policy, which is part of them.


1. What LumiJar is (and isn't)

LumiJar is educational software for families: a tool built around the tooth-fairy ritual that helps parents teach children money habits and healthy-teeth habits, using virtual money only.

You agree to use LumiJar only for your own family's personal, non-commercial use, and not to: misuse or attempt to circumvent security or rate limits; probe, scrape, or reverse-engineer the service; use it to violate any law or anyone's rights; upload content that is unlawful, harmful, or infringing; or create accounts by automated means.

Content you enter about your child is entered under your parental authority. Enter only what you are comfortable storing, and use first names or nicknames for children.

4. Your content

You own the content you and your family create in LumiJar — names, notes, letters, goals, and tooth records. You grant Lumiti a limited license to host, store, process, display, and transmit that content solely to operate and improve the service for your family. We claim no ownership of it, and we do not use children's personal information for advertising or sell it. See the Privacy Policy.

5. Our content

LumiJar — including its software, design, characters (such as the animated jar and coach characters), text, and branding — is owned by Lumiti, LLC or its licensors and protected by intellectual-property law. We grant you a limited, revocable, non-exclusive, non-transferable license to use LumiJar for your family's personal use. "LumiJar" and "Lumiti" are trademarks of Lumiti, LLC. No rights are granted except as stated here.

6. Price and changes to the service

LumiJar is currently offered free of charge. We may introduce optional paid features in the future; if we do, pricing and terms will be disclosed clearly before you are asked to pay, and no charge will ever occur without your explicit action. We may add, change, or remove features of the service, and we will use reasonable efforts to notify you of material changes.

7. Termination

You may stop using LumiJar at any time. From the dashboard you can delete an individual child's profile or all of your family's data, which removes it from our servers. To delete your account login record itself — your email address and password — email privacy@lumijar.com. Deletion is described in the Privacy Policy.

We may suspend or terminate an account that violates these Terms, abuses the service, or creates risk for us or other users, with notice where practicable. Sections that by their nature should survive — 4, 5, and 8 through 11 — survive termination.

8. Disclaimers

LumiJar is provided "as is" and "as available." To the fullest extent permitted by law, Lumiti disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that data will never be lost — please remember that LumiJar is a keepsake and learning tool, not a system of record. Because of this, we provide export tools (a transaction ledger and a full backup) so you can keep your own copy of your family's data at any time, and we encourage you to do so.

9. Limitation of liability

To the fullest extent permitted by law, and regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), Lumiti will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or use, arising from or relating to LumiJar, even if Lumiti has been advised of the possibility of such damages and even if any limited remedy fails of its essential purpose.

Lumiti's total aggregate liability for all claims arising from or relating to LumiJar will not exceed the greater of (a) $100 or (b) the total amount you paid Lumiti in the twelve months before the event giving rise to the claim.

Nothing in this section limits or excludes any liability that cannot be limited or excluded under applicable law — including, where applicable, liability for gross negligence, willful misconduct, fraud, death or personal injury caused by negligence, or any statutory rights that cannot be waived. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you; in that case, these limitations apply only to the extent permitted by law.

10. Indemnity

To the extent permitted by law, you will indemnify and hold Lumiti harmless from third-party claims arising out of your unlawful use of the service or your breach of these Terms. This does not apply to claims caused by Lumiti's own conduct.

11. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules, except that if you are a consumer, the law of your state or country of residence applies to the extent it grants you rights that cannot be waived by agreement.

Any dispute arising out of or relating to these Terms or LumiJar will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you and Lumiti consent to the personal jurisdiction and venue of those courts, except where this requirement is prohibited by applicable law. Either party may bring a qualifying individual claim in small-claims court instead.

If any part of this section is found unenforceable, that part will be enforced to the maximum extent permitted and the remainder will stay in full effect.

12. Changes to these Terms

We may update these Terms. For material changes we will notify the parent account email and post the update with a new effective date; continued use after the effective date is acceptance. Material changes affecting children's data follow the Privacy Policy's consent rules.
